These Terms of Service ("Terms") govern your access to and use of TimberCloud, provided by TimberCloud, Inc. ("TimberCloud," "we," "us"). By creating an account or using the service, you agree to these Terms.
Accounts
You must provide accurate account information and keep your credentials secure. You are responsible for activity under your account. You must be at least 18 and have authority to bind the company you represent.
Subscription and billing
Paid plans renew automatically until cancelled. Fees are billed in advance and are non-refundable except where required by law. Platform fees on storefront orders are billed in addition to plan fees and are described on the pricing page. You may upgrade or downgrade at any time; prorated charges apply.
Acceptable use
Do not use TimberCloud to violate law, infringe rights, send unsolicited bulk email, distribute malware, attempt to gain unauthorized access, or interfere with the service. We may suspend or terminate accounts that violate these Terms.
Your data
You retain ownership of the data you put into TimberCloud. You grant us a license to host, process, and transmit your data solely to provide the service. We handle your data per the Privacy Policy.
Intellectual property
TimberCloud, the software, and the website are owned by TimberCloud, Inc. or its licensors. We grant you a limited, non-exclusive, non-transferable license to use the service per these Terms.
Disclaimers
The service is provided "as is," without warranties of any kind, to the maximum extent permitted by law.
Limitation of liability
To the maximum extent permitted by law, TimberCloud's aggregate liability under these Terms will not exceed the fees you paid in the twelve months before the event giving rise to the claim. We are not liable for indirect, incidental, or consequential damages.
Termination
You may cancel at any time from your account settings. We may suspend or terminate the service for material breach of these Terms after reasonable notice (or immediately for security or legal reasons).
Governing law
These Terms are governed by the laws of the State of Connecticut, USA, without regard to conflict-of-laws principles. Disputes will be resolved in the state or federal courts located in Connecticut.
